Good Day Everyone
Today's topic is about Law. There are plenty we can talk about law, actually this topic is a very vast one. So let's pick the most basic one, the very beginning, about how we should make the law.
There are many approaches we can use for guiding us in making a law. For example, I grow up in Islam majority family, I am not a Muslim but most of my cousin are. In Islam teaching, we have Syaria law or Islamic law.
For all individuals who hold Islam as their belief, they should adhere to Sharia Law, which is a comprehensive system of laws derived from the Holy Quran (The Bible). The Sharia Law is claimed to be a completed and the better of all, which alse rule over personal matters, social interactions, and governance.
However human is a human after all, although they believe their God has bestowed them the given Law, many still prefer not to adhere the Sharia Law. So it is still a deep issue within the Muslim community, and my post is not be written to meddle with that issue.
The essence I like to rise up is related to that one, but not about Sharia Law. It is about humanity. When we write up laws, let say for a country or an organization, we can not forget the human because Human are the subject and the object of the Law.
However we can not forget that nothing is perfect in this world, all of us have our limit and that makes us unable to make something perfect or reaching perfection. No Law is perfect, however all law should be refined with the best effort we can give.
With law, we will set boundaries that define which ones are legal and which ones are illegal. And hopefully if everything are done within the boundary of legal, people won't get hurt and everything should be fine.
However... nothing perfect in this world.
Should ethics and morals be considered when making laws in a country? Just because something isn't ethical or moral, should it be deemed illegal? As long as no crime is committed and no one gets hurt, shouldn't everyone have a right to do whatever they want regardless of how morally bankrupt their acts may be?
Ethic And Moral
Whenever we talk about humanity, it is not solely about logic and intelligence, we need to go wider and beyond those two, which one of them are values. There is not always be the right one, sometime or maybe most of the time we can see several things are good, several things can be right at the same, so which one we should define as the reference for the right one?
The answer is back to the values we hold. There are many values, so sometime you can see clearly people have different values, and those values will drive them to make different decision. Those values we or they hold come from morality and ethics.
So what is morality? It is a set of cultural belief about what is right and what is wrong. And for Ethics, they are principles or some people say it is philosophical belief that guide how people should behave. Together they are our compass on how we should put ourselves in society and how as collective will define a good society is.
So as I have said above that the law is built for humanity, upon shared values, beliefs, principal and cultural norms, so undeniable that Ethics and Morals are already there when the law is made.
If someone ask, "Should ethics and morals be considered when making laws in a country?" It is a silly question because those ethics and morals are the backbone of the law itself.
However nothing perfect in this World
The Imperfection
I have said above that laws are built based upon ethics and morality, however sometime they seem to be off, unconnected from those two. Laws is meant to be an embodiment of Ethics and morality, they run as a system of rules enforced by institutions. The consensus and reprehensibility of things differ for everyone, this make the connection between law and morality feel unclear.
Laws runs as mandates, they define explicitly what we can do or cannot do, and disobedience will result with penalties. In the other hand, morality and ethics are not mandates that strictly dictate us directly what to do or what we must not to do. They do not force us to do something but guide us to do something based on conscience, beliefs and values. This may be the reason why some people believe that laws are created without involving moral or ethical considerations.
